Agreement

By downloading or using Gentle Orb, you agree to these terms. If you do not agree, please do not use the app. These terms form a legal agreement between you and Gentle Ground

What Gentle Orb Is

Gentle Orb is a support tool for parents and caregivers of children with neurodivergent needs. It provides emotional regulation tools, daily routine support, calming sounds, breathing exercises, and creative activities.

Gentle Orb is not a medical device, clinical tool, or substitute for professional support. It does not diagnose, treat, or manage any medical or psychological condition. If your child is experiencing a mental health crisis or medical emergency, please contact emergency services or a qualified professional immediately.

Who Can Use the App

You must be at least 18 years old to create an account or use Gentle Orb. The app is intended to be used by parents, guardians, and caregivers on behalf of their children.

Children may use the child-facing features of the app under parental supervision. Children should not use account or settings features independently.

In compliance with the Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information directly from children under 13. All profile information about a child is provided by a parent or guardian. If you believe we have inadvertently collected information from a child under 13, contact us immediately at [support@gentleground.org].

Your Account

If you sign in with Apple, you are responsible for maintaining the security of your Apple ID. We are not liable for any loss or damage resulting from unauthorized access to your account.

You can delete your account at any time from Parent Settings → Account & Sync → Delete my account. Deletion is permanent and cannot be reversed.

Acceptable Use

You agree to use Gentle Orb only for its intended purpose — supporting the emotional wellbeing of your child. You agree not to:

• Use the app to harm, harass, or deceive anyone
• Attempt to reverse engineer, copy, or extract the app's code or content
• Use the AI features to generate content that is harmful, abusive, or illegal
• Share your account with people who are not caregivers of the child the profile is set up for
• Use the app in any way that violates applicable laws or regulations

AI Features

Gentle Orb uses Anthropic's Claude AI to power several features including the routine builder, personalized tips, and sound matching. These features are designed to be helpful and supportive, but AI-generated suggestions are not professional advice.

Parent tips and routine suggestions are general recommendations only. You know your child best. Use your own judgement and consult qualified professionals for medical, therapeutic, or educational decisions.

AI-generated content may occasionally be inaccurate or not suitable for your specific situation. We are not liable for decisions made based on AI-generated suggestions.

Premium Features

Gentle Orb offers a free tier and a premium subscription. The free tier includes core emotional regulation tools — breathing, calming sounds, sensory play, and the hand-it-over feature. Premium unlocks additional features including:

• Sound Lab — personalized sound discovery sessions with Claude analysis
• AI Routine Builder — generate a full daily schedule from a plain-language description
• Personalized parent tips — context-aware guidance generated for your specific child
• Movie Maker AI — AI-generated stickers, backgrounds, and a personalized movie persona
• Extended sound library — additional calming sound varieties beyond the four bundled tracks

Subscriptions are managed through the Apple App Store. By subscribing, you agree to Apple's payment terms and App Store policies.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID account settings.

We do not offer refunds outside of Apple's standard refund policy. To request a refund, contact Apple Support directly.

Intellectual Property

All content in Gentle Orb — including Orby the character, visual design, illustrations, sounds, and written content — is owned by Gentle Ground and protected by copyright. You may not reproduce, distribute, or create derivative works from any part of the app without our written permission.

Content you create within the app (routines, custom activities, movie recordings) remains yours.

Third-Party Services

Gentle Orb integrates with third-party services including Anthropic (AI) and ElevenLabs (voice). Your use of these features is also subject to their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party services.

Disclaimer of Warranties

Gentle Orb is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the app will be error-free, uninterrupted, or suitable for any particular purpose.

The app is designed to be helpful, but every child is different. We cannot guarantee that any feature — sounds, breathing exercises, routines, or AI suggestions — will have a specific effect on your child.

Limitation of Liability

To the maximum extent permitted by applicable law, Gentle Ground shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Gentle Orb, including but not limited to loss of data, loss of profits, or emotional distress.

Our total liability for any claim arising from these terms or your use of the app shall not exceed the amount you paid for the app or subscription in the 12 months preceding the claim.

Governing Law

These terms are governed by the laws of the United States. To the extent permitted by law, disputes shall be resolved in the federal or state courts located in Oregon. Any disputes shall be resolved in the courts of that jurisdiction.

Changes to These Terms

We may update these terms from time to time. If we make significant changes, we will notify you within the app. Continuing to use the app after changes take effect constitutes your acceptance of the new terms.

AI Voice & Third-Party Services

Gentle Ground uses artificial intelligence technologies, including third-party services such as ElevenLabs, to generate audio features within the app (including calming narration and communication tools).

By using these features, you acknowledge and agree that:

Text or inputs provided within the app may be processed by third-party AI services solely to generate audio output

Gentle Ground does not knowingly transmit personally identifiable information of children to these services

AI-generated voices are synthetic and not representations of real individuals

Voice cloning or use of identifiable voices will only occur with explicit consent

Users agree not to use the app to create harmful, misleading, or inappropriate content

Gentle Ground is not responsible for misuse of AI-generated audio outside the intended purpose of the app.
